The act of forging judicial decisions, which involves the dishonest creation or modification of legal documents to facilitate deportation and avoid complying with court-mandated compensations, poses grave threats to individuals in the UAE and the integrity of the legal framework. This disregard for legal rulings over the past 27 years indicates a systemic failure and an attitude of superiority above the law, undermining the foundational principles of justice and accountability.
The message to the "UAE Government" is clear: The UAE's reputation and its relations with the international community are at stake, start respecting the courts and rectifying the injustices committed. The various forms of reparation law and their scope and content, covering both monetary and non-monetary reparations, may be summarized in its five forms consists restitution, compensation, rehabilitation, satisfaction and guarantees of non-repetition. Reparation shall render justice by removing or redressing the consequences of the wrongful acts and by preventing and deterring violations.
The right to a remedy and reparation(1) for the breach of human rights is a fundamental principle of international law recognized in numerous treaty texts and affirmed by a range of national and international courts. The larger part of the Principles and Guidelines, with strong domestic law implications, sets out the status and the rights of victims, and corresponds to the title of the document as it refers to the right of victims to a remedy and reparation (in particular principles 11-23).
A core component of the Principles and Guidelines, denoting a broad range of material and symbolic means to afford reparation to victims, is laid out in the principles describing the various forms of reparation. They were formulated with the Articles on State Responsibility of the International Law Commission in mind.
The five forms of reparations are explained here below namely (1) restitution, (2) compensation, (3) rehabilitation, (4) satisfaction and (5) guarantees of non-repetition.
Restitution
Restitution(2) refers to measures which “restore the victim to the original situation before the gross violations of international human rights law and serious violations of international humanitarian law occurred” (principle 19). Examples of restitution include: restoration of liberty, enjoyment of human rights, identity, family life and citizenship, return to one’s place of residence, restoration of employment and return of property. INVEST IN REPARATION LAW: ‘INVEST IN INDIA-UAE JUSTICE FRAMEWORK AND REPARATIONS'. Human Rights are the foundation of freedom, justice, and peace, and are the basic standards without which people cannot live a life of dignity. Discrimination is abuse that prevents people from enjoying their basic human rights and thus undermining the very concept of a universal right.
The ‘International Law' is fairly clear that the governments have a duty of ratifying human rights treaties and mechanisms, focused on the recognition of victims’ rights and dignity; their protection and promotion is the first responsibility of States, in doing so, commit to meeting certain human rights obligations of the states.
Unlike all other regions, the establishment of regional inter-governmental Human Rights mechanisms, to date, a mechanism to enable individuals to seek redress, has not been created between India and its neighbouring countries.
